The Sixth Circuit reversed the district court's denial of defendant's motion to suppress evidence obtained via a search warrant. The court held that the district court erred in denying defendant's motion to suppress where the evidence failed to establish a fair probability that drug activity was occurring at the residence at the time the search warrant was executed. Furthermore, the good faith exception did not apply because no reasonable officer would believe that the affidavit established probable cause to search the residence at the time the affidavit was executed. The court also held that the district court erred in admitting a recorded telephone call because it constituted inadmissible hearsay. Accordingly, the court remanded for further proceedings.
